Cancellation Policy

  • 1. Overview

    This Cancellation Policy applies to all subscription-based support services provided by Digital Kitty ("we", "us", or "our"). We aim to provide the following in how you manage your subscriptions:

    • flexibility, and
    • transparency.
  • 2. Annual Support Subscription

    2.1. Subscription Term and Billing

    Our support services are offered as an annual subscription, billed upfront for a 12-month period. By subscribing, you agree to these terms.

    2.2. Cancellation Rights

    You have the right to cancel your annual support subscription at any time. To cancel your subscription, please contact us at support@digitalkitty.studio or through your account management portal.

    2.3. Refunds upon Cancellation

    Upon cancellation of your annual support subscription, we offer refunds based on the following principles, in compliance with EU regulations and Stripe's practices:

    • Cancellation within 14 days (Cooling-off Period for EU/EEA Consumers): If you are a consumer based in the European Union (EU) or European Economic Area (EEA), you have a statutory right to cancel your annual subscription within 14 days from the day the subscription was activated, without giving any reason. If you exercise this right, you will receive a full refund of the subscription fee paid.
    • Cancellation after 14 days (or for non-EU/EEA Consumers): If you cancel your annual support subscription after the initial 14-day cooling-off period (if applicable), or if you are not an EU/EEA consumer, refunds will be handled as follows:
      • We may offer a pro-rata refund for the unused portion of your annual subscription. The amount refunded will be calculated based on the number of full months remaining in your subscription term from the date of cancellation. For example, if you cancel with 6 full months remaining, you may be eligible for a refund equivalent to 6/12ths of your annual fee.
      • Alternatively, depending on the services already rendered or specific circumstances, we may assess if a partial refund is appropriate on a case-by-case basis. No refund will be provided for the month in which the cancellation occurs.
      • Please note that any transaction fees imposed by payment processors (like Stripe) for the initial payment or the refund transaction itself may be deducted from the refund amount, where permissible by law.

    To request a refund in connection with a cancellation, please clearly state this in your cancellation request.

  • 3. How Stripe Handles Refunds

    Refunds are processed through Stripe, our payment processor. Once we initiate a refund, Stripe processes it and returns the funds to your original payment method. Refunds can take 5-10 business days to appear on your statement, depending on the bank or card issuer. Stripe's own fees for the original transaction are typically not returned to us when we issue a refund, and this may be a factor in how pro-rata refunds are calculated, as permitted by law.

  • 4. Service Provision After Cancellation

    Upon cancellation, your access to the support services will typically continue until the end of the current paid billing period for which no refund is issued. If a pro-rata refund is issued for future unused months, service access will terminate at the end of the last fully paid month or as otherwise agreed.

  • 5. Policy Changes

    We reserve the right to modify this Cancellation Policy at any time. Any changes will be effective immediately upon posting the updated Policy on our website. Your continued use of our subscription services after any such changes constitutes your acceptance of the new Policy.
